Ombudsman Conchita Carpio Morales has indicted ex- President Benigno “Noynoy” Aquino III for usurpation of authoritative controls over the controversial Disbursement Acceleration Program (DAP).
According to news report on Wednesday, the Office of the Ombudsman said Morales found “probable cause” to file a case against Aquino for the alleged unlawful issuance of National Budget Circular No. 541 for the implementation of DAP, an economic stimulus program.

Morales ordered a formal charge against Aquino for violation of Article 239 of the Revised Penal Code. Be that as it may, the indictment may in any case still be subjected to a motion for reconsideration.
Meanwhile, regarding Aquino’s indictment, Presidential Spokesperson Harry Roque said in an instant message, “Let justice be done.”
The indictment was ordered in the wake of following up on the motions for reconsideration filed by complainant-movants Rep. Carlos Isagani Zarate, Renato Reyes, Benjamin Valbuena, Dante LA Jimenez, Mae Paner, Antonio Flores, Gloria Arellano and Bonifacio Carmona, Jr.
The Ombudsman said the earlier indictment originated from the unlawful issuance of National Budget Circular (NBC) No. 541 to use the DAP involving public funds worth P72 billion.
Ex- Budget Secretary Florencio Abad was the only government official found accountable in the assumed unlawful usage of DAP a year ago.
